Sexual Assault Forensic Examination
A Sexual Assault Forensic Examination is performed within the first 72 hours of the sexual assault when you wish to file a report with the police. It is OK if you are not sure about having the sexual assault forensic examination now. You may need some more time to think about it. You may have a medical examination by the emergency room doctor and choose to return for the sexual assault forensic examination at any time as long as it is within 72 hours of the assault. However, you need to know that evidence diminishes over time. A sexual assault forensic examination is recommended as soon as possible after an assault to gather evidence that may help prosecute a criminal case against the alleged assailant. It is best to file a report with the police and have a sexual assault forensic examination even if you are not sure about filing charges. The evidence will be held by the police for a period of time or until you decide to have the charges filed.
The following people will be called to the emergency room for a sexual assault forensic examination:
- A police officer in the jurisdiction where the crime occurred, to conduct an interview and file a report.
- A SAFE nurse, to gather evidence and administer medications to prevent pregnancy and certain sexually transmitted diseases (STD).
- An advocate from the YWCA Sexual Assault Prevention & Counseling Center (SAPCC), to provide emotional support to the victim, as well as offer counseling and legal advocacy services.
In order for a sexual assault forensic examination to occur, you must be willing to speak to, and cooperate with the police investigation.
For an Assault more than 72 hours ago or you do not wish to file charges a Medical Examination can be performed by the ER doctor to treat any injuries you may have. Your primary nurse can administer the medications that aid in the prevention of pregnancy or common STD's if you opt for this treatment. The ER staff must notify the police in the jurisdiction where the assault occurred and they will inform the police officer that you do not wish to file charges at this time. Some police jurisdictions may respond to the ER to speak with you so they can hear first hand that you do not wish to file charges.
If you choose a medical examination over a sexual assault forensic examination at the time of your emergency room visit or the assault occurred greater than 72 hours ago you can still report the crime to the police in the jurisdiction where the crime occurred at any time. Crime Victims' Compensation may cover all medical bills, but you must be willing to cooperate with the police in the possible prosecution of the crime committed against you.
We certainly understand if you are frightened or nervous about reporting the assault. Please don't hesitate to call the YWCA Sexual Assault Prevention & Counseling Center and speak with an advocate. Someone is available 24 hours a day to speak with you regarding your concerns.
